Plant Sickness Identifier
Terms of use
About these terms
These terms are an agreement between you and The Apptor (“we”, “us”) for the Plant Sickness Identifier app on iPhone and Android and this website. By using the app you accept them. Our privacy policy explains how we handle your data.
The app identifies plants from photos, suggests what may be wrong with them, gives a rescue plan and answers plant care questions through its assistant, Sprouty. These answers are generated by AI.
AI guidance is for information only
- Results and replies are suggestions, not professional advice. AI can be wrong about the plant, the problem or the treatment, especially with unclear photos or problems that look alike.
- The app says how confident it is, but that is not a guarantee. You decide what to do with your plants.
- For valuable plants, crops grown to sell, or a serious or spreading problem, check with a garden centre, plant expert or local agricultural advice service before you act.
- Information on whether a plant is toxic to people or pets may be incomplete. Never eat a plant, or let a pet eat one, because the app says it is safe.
Garden chemicals and safety
- Some rescue plans mention fungicides, pesticides or other garden chemicals. Always read and follow the product label, which takes priority over anything the app says.
- Use only products that are legal where you live and approved for that plant, and wear the protection the label asks for.
- Keep children and pets away from treated plants for as long as the label says, and on edible plants wait the stated time before picking.
- If a person or animal may have swallowed a plant or a chemical, contact a doctor, vet or poison information service straight away.
Free uses and Premium
- Free uses. Without Premium, you get a number of free uses each day, shared between scans and messages to Sprouty. The app shows how many you have left. The number may change, and unused uses do not carry over to the next day.
- Premium is an auto-renewing subscription, weekly or yearly, that removes the daily limit for scans and messages. Reasonable limits that protect the service still apply, such as a cap on requests per minute.
- Payment. The price and period are shown in the app before you buy. Payment is taken by your App Store or Google Play account when you confirm the purchase.
- Renewal. The subscription renews automatically at the same price and for the same period unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends. If the price changes, Apple or Google tells you first, as their rules require.
- Your history, the plant problems library, sharing and reminders stay free.
Cancelling and refunds
- Manage or cancel your subscription in your App Store or Google Play account settings. The app's Settings has a Manage subscription button, and the support page shows the steps.
- Deleting the app does not cancel a subscription.
- After you cancel, Premium stays on until the end of the period you have paid for.
- Refunds are handled by Apple for App Store purchases and by Google for Google Play purchases, under their refund policies. The support page explains how to ask.
- Use Restore purchases in the app's Settings to get Premium back on a new phone with the same Apple ID or Google account. Subscriptions do not move between iPhone and Android.
Nothing in these terms affects your legal rights as a consumer.
Acceptable use
Use the app for plants and plant care. Do not:
- upload anything unlawful, or photos of other people without their permission;
- try to get around the free use limits, reverse engineer the app or its server, or send automated requests;
- use the app or its answers to harm people, animals or the environment.
We may limit or block access from an install that breaks these rules or puts the service at risk.
Your photos
Your photos and messages remain yours. You allow us to send them to Google Gemini, through our server, only to produce your result or reply, as the privacy policy describes. If you send feedback on a result, you allow us to use that feedback, without the photo, to improve the app.
Our app
The app, its design, text and illustrations belong to The Apptor. We give you a personal, non-transferable right to use the app on devices you own or control, for your own non-commercial use.
The app depends on services from other companies, including Google Gemini for results and replies. We work to keep it running but cannot promise it will always be available or free of errors. We may change, add or remove features over time.
App Store and Google Play
If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies to your use of the app and your purchases. Apple is not responsible for the app or its support; we are. If you got the app from Google Play, Google Play's terms also apply to your purchases.
Our responsibility to you
- We are not responsible for the loss of or damage to plants, crops or harvests, or for any result of using a treatment, whether or not the app suggested it, as far as the law allows.
- We are not responsible for losses that were not foreseeable, or for business losses.
- Where the law allows us to limit our responsibility, our total liability to you is limited to what you paid for the app in the 12 months before the claim.
- Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Changes and ending
We may update these terms. When we do, we change the date at the top, and we mention important changes in the app's update notes. If you keep using the app after a change, the new terms apply. You can stop at any time by cancelling any subscription and deleting the app.
Governing law and contact
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear disputes. If you live elsewhere in the UK or in the EU, you can also bring a claim in the courts where you live, and you keep the protection of your local consumer law.
